Terms of Service

The terms governing access to Noctlight, online purchases, content, and customer responsibilities.

1. Agreement

By using this site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, Return & Refund Policy, and applicable product-specific terms. If you do not agree, do not use the services.

2. Eligibility and accounts

You must be legally capable of entering a binding agreement. You are responsible for accurate account information, safeguarding credentials, and activity under your account.

3. Product information

We seek accurate descriptions and images, but screen color, handmade variation, natural materials, measurements, and finishes may vary. Customers must review dimensions, voltage, bulb type, ratings, installation requirements, and local compatibility before purchase.

4. Orders and pricing

An order confirmation acknowledges receipt and does not guarantee acceptance. We may decline or cancel orders for pricing errors, suspected fraud, inventory issues, legal restrictions, or inability to serve an address. If a cancelled order was charged, we will refund the amount paid. Prices and promotions may change prospectively.

5. Installation and safe use

Hardwired lighting must be installed by a qualified licensed professional in accordance with product instructions, electrical codes, and local law. The customer is responsible for determining suitability, structural support, voltage compatibility, and required permits. Disconnect power before installation or service.

6. Intellectual property and acceptable use

Site content, text, images, graphics, trademarks, and design are owned by or licensed to Noctlight. You may use the site for personal shopping only. Scraping, interference, fraudulent activity, unlawful use, and unauthorized commercial reproduction are prohibited.

7. Third-party services

Payment, carrier, social, analytics, and linked third-party services are governed by their own terms. We are not responsible for independent third-party content or services except as required by law.

8. Disclaimers and liability

To the fullest extent permitted by law, services are provided “as available.” We do not exclude warranties or liabilities that cannot legally be excluded. Noctlight is not liable for indirect, incidental, special, or consequential losses arising from use of the site or products, except where prohibited. Any aggregate limitation will not exceed the amount paid for the affected product, where legally permitted.

9. Indemnification

To the extent permitted by law, you agree to indemnify Noctlight against third-party claims caused by your unlawful use, violation of these Terms, or improper installation or modification.

10. Governing law and disputes

These Terms are governed by applicable laws of California and the United States, without limiting non-waivable consumer protections of your home jurisdiction. Courts located in Los Angeles County, California will have jurisdiction where legally permitted. Before filing a claim, contact us so we can attempt an informal resolution.

11. Severability and changes

If a provision is unenforceable, the remainder continues. Updated Terms apply prospectively from publication unless law requires otherwise.

Electronic communications

You consent to receive order confirmations, notices, disclosures, and records electronically. Keep a current email address and copies of important transaction records.

Reviews and submitted content

If you submit a review, image, suggestion, or other non-confidential content, you confirm you have permission to do so and grant Noctlight a non-exclusive, worldwide, royalty-free license to use it for operating and promoting the services, subject to privacy law. We may remove unlawful, deceptive, infringing, or abusive content.

Events beyond reasonable control

Neither party is responsible for delay caused by events beyond reasonable control, including natural disasters, government actions, carrier disruption, labor interruption, epidemic, conflict, or infrastructure failure. Payment obligations and consumer remedies that cannot lawfully be limited remain unaffected.

Entire agreement and waiver

These Terms and incorporated policies form the agreement for the services. A failure to enforce a provision once is not a continuing waiver. Headings aid navigation and do not change meaning.
